RETRO FUSION GAMES TERMS OF SERVICE
AND END-USER LICENSE AGREEMENT (EULA)

Please read these Terms of Service carefully. By downloading the application or accessing or using the service, you agree to be bound by these Terms and all terms incorporated by reference. If you do not agree to these Terms, do not download or use the service.
A. RETRO FUSION GAMES TERMS OF SERVICE
1. Service
Retro Fusion Games ("RFG," "we," "our") operates applications, games, and related services on mobile and PC devices (collectively, the "Service"). The Service collects personal, demographic, and location-based information to enhance gameplay and enable personalized interactions. By using the Service, you agree to provide accurate information, refrain from generating misleading data, and comply with all game rules. Misuse may result in forfeiture of any earned rewards or credits.
Location Tracking: By using the Service, you consent to the automatic collection of location-based data when your device is enabled. You may opt out by disabling location services or uninstalling the application.
2. Eligibility
The Service is intended for users aged 14 and older. If you are between 14 and 18, you must review these Terms with a parent or guardian. The Service is designed for use in the United States, Canada, United Kingdom, and Australia, and is not intended for use in other regions.
3. Privacy Policy
Please refer to our Privacy Policy for information on how RFG collects, uses, and discloses personal information.
4. Rewards and Compensation
When participating in games or tournaments, users may receive rewards, incentives, or in-game currency based on gameplay achievements.
- Brokered Contests: For specific tournaments hosted by third-party partners ("Brokers"), Brokers may offer rewards. RFG is not liable for the payment or nonpayment of any reward offered by Brokers.
- Retro Fusion Games Rewards: RFG may award in-game currency or achievements. RFG reserves the right to alter the reward rate at any time without notice. Users who wish to discontinue participation due to changes in reward rates may stop using the Service.
5. Fees and Charges
Usage of the Service may incur data charges or fees from your carrier. We recommend using a device with an unlimited data plan. Purchases within the Service do not impact gameplay difficulty or success rates, which are determined solely by skill and gameplay experience.
6. Third-Party Content and Advertisements
The Service may contain third-party content, links, or advertisements. RFG does not control or endorse third-party content and is not liable for any associated risks. Users access third-party content at their own discretion.
7. Modifications to Service and Termination
RFG reserves the right to modify, suspend, or discontinue the Service or features at any time without notice. We may terminate or suspend accounts at our discretion, with or without cause, including but not limited to violations of these Terms. Any accrued rewards may be claimed by contacting us at support@retrofusiongames.com within 30 days of termination.
B. END USER LICENSE AGREEMENT (EULA)
1. License
RFG grants you a non-exclusive, non-transferable license to use the Service on devices you own or control. This license applies to future updates unless provided with a separate license.
2. Restrictions
You agree not to distribute, sublicense, reverse engineer, or create derivative works of the Service. Violating these restrictions may result in the termination of your license and legal consequences.
3. Data Collection and Communications
RFG may collect device and location data to enhance the Service. By using the Service, you consent to receive updates and notifications related to gameplay. Standard carrier messaging and data rates apply.
4. Third-Party Interactions
Your use of third-party content or services through the Service is at your own risk. RFG is not responsible for any interactions or agreements made with third parties through the Service.
5. User Conduct and Content
You are solely responsible for any content shared or interactions made through the Service. RFG is not liable for any damages resulting from other users’ content or conduct.
6. Ownership
The Service, including all proprietary content, is the exclusive property of RFG and its licensors. Unauthorized use of the Service is strictly prohibited.
7. Changes and Termination of License
RFG reserves the right to modify or discontinue the Service at any time without notice. If terminated, you must immediately cease use and delete all copies of the Service from your devices.
8. Export Limitations
You agree not to use, export, or re-export the Service in violation of any applicable laws, including U.S. export restrictions.
C. GENERAL TERMS
1. Disclaimers
The Service is provided on an "as-is" and "as-available" basis. RFG disclaims all warranties, express or implied, including warranties of accuracy, performance, and fitness for a particular purpose. No advice or information given by RFG shall create a warranty.
2. Limitation of Liability
To the maximum extent permitted by law, RFG shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use or inability to use the Service. RFG’s total liability shall not exceed one dollar ($1.00 USD).
3. Severability
If any part of these Terms is deemed unenforceable, that part will be removed, and the remaining Terms will continue in full force.
4. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Kansas, USA. Any disputes arising from these Terms will be settled in the state and federal courts of Sedgwick County, Kansas.
